Trump Teases Filing Fourth Amendment Motion Against FBI and DOJ

Former President Donald Trump warned that he would file a “major motion” against the FBI and Justice Department before the midterm elections, according to his posts on social media.

The motion would be related to the Fourth Amendment, which protects citizens from unreasonable searches and seizures by the government, Trump said. The warning, which was part of a rant on his social media platform, Truth Social, comes in the wake of an FBI raid of Trump’s Mar-a-Lago resort in Palm Beach, Florida, earlier this month.

“A major motion pertaining to the Fourth Amendment will soon be filed concerning the illegal Break-In of my home, Mar-a-Lago, right before the ever important Mid-Term Elections,” Trump posted. “My rights, together with the rights of all Americans, have been violated at a level rarely seen before in our Country.”

The “witch hunt” against Trump has been going on for six years, the former president claimed, adding that the acts of federal law enforcement resembled those of leaders in Third World countries.

“Nothing has ever happened like that which is going on in our Country right now,” Trump said in a post. “The law enforcement of our Country has become that of a Third World Nation, and I do not believe the people will stand for it — between Fraudulent Elections, Open Borders, Inflation, giving our Military to the Enemy, and so much more — how much are we all expected to take?”

The FBI executed a search warrant of the resort Aug. 8, seizing 11 boxes of documents that included top secret information. The raid was part of a broader investigation into Trump for a possible violation of 18 U.S.C. 793, part of the Espionage Act. Trump claimed to have declassified all the information in the boxes due to a “standing order” that declassified documents the moment he took them out of the Oval Office.

Former administration officials have denied the claim, however, stating they had no knowledge of such an order.

Magistrate Judge Bruce Reinhart approved unsealing of the search warrant last week and approved the release of additional documents related to the raid, including the motion to seal the search warrant. Reinhart teased unsealing parts of the affidavit Thursday, ordering the Justice Department to file a redacted version of the affidavit by next Thursday.
